Definition of
Disability
"Disability" is defined by the Social Security Administration (SSA) as a person's inability to perform any kind of work for which he/she is because of an injury or a medical condition. The disability should be expected to last for one year or result in death. The disability can be a result of a physical or mental condition, or a combination of a number of such conditions. There are two types of Social Security insurance benefits:
-
Social Security Disability Insurance (SSDI). These benefits are available for those individuals that have worked and paid FICA taxes for five of the ten years prior to the date of being totally disabled. The requirements are adjusted for individuals under 31 years of age, since they have not been inthe work force as long.
-
Supplemental Security Income (SSI) These benefits are paid to individuals whom are low income and disabled. Whether or not the individual has worked in the past. SSI childrens' disability benefits are paid to children under the age of 18 who are disabled.
When can you apply for Social Security Disability benefits?
-
You can apply for Social Security Disability on the first day that you become disabled.. Any individual who suffers a serious illness or injury and expects to be off work for a year or more should not delay in filing a claim for Social Security Disability benefits. Any benefits awarded by the SSA will be retroactive to the date you became disabled.
-
Presently over 80% of initial claims and 60% of all reconsiderations are denied by the Social Security Administration. As a result, many deserving Social Security claimants become discouraged and frustrated and forfeit their legal rights by failing to appeal their reconsideration denial to the Administrative Law Judge level.
What can an experienced Social Security Disability attorney do to increase your chances of receiving Social Security benefits?
-
Obtain from the SSA the benefit amount you can expect to collect.
-
Review all existing medical documentation and obtain additional medical reports if necessary.
-
Review and assist you in completing the forms which are sent to you by the adjudicator in connection with your initial application and appeals.
-
Prepare your testimony for the hearing before the administrative law judge.
-
At a hearing, cross examine the witnesses and help develop favorable testimony.
